The Case Lawyer and his assistant prepare a Settlement Brochure that sets out the theory of fault against the defendant, the person who caused the accident with the client.  

This includes:

  • The controlling law that establishes why the defendant is responsible to pay for our client’s damages; 

  • The extent of the client’s damages; 

  • The nature and extent of the client’s injuries; 

  • The amount of his or her medical bills; 

  • The amount for which our research has indicated that the case should be settled.

The settlement demand is based on the amount that juries have awarded in similar cases in the past. This information is researched by a thorough study of “jury sheets,” hard copy and computer records of case descriptions and jury awards throughout the geographical area where the case would go to trial if it did not settle.  

After the results of the case evaluation, a decision is then made as to the level of trial lawyer to be assigned. Team leader lawyers are experienced trial lawyers and, after consulting with the client, and receiving the client’s permission to proceed, the wheels are put into motion to take the case to trial in the event it does not settle.
