Filing a workers’ compensation claim requires strict adherence to specific legal procedures and timelines under the law. Negotiating with Insurance Company

Insurance companies have experience and vast resources, and they use this power to try to pay out as little money as possible in most cases. When you have a Los Angeles workers’ compensation lawyer by your side, it evens the playing field. They can negotiate with the insurance company on your behalf to ensure you get the compensation you truly deserve.

Overall, securing legal assistance can result in a less stressful experience and gives you the best chance of securing your rightful workers’ comp benefits for your workplace injury.

What are California’s Workers’ Compensation Laws?

In Los Angeles, workers’ compensation is designed to protect employees injured on the job. If you’re hurt while performing your work duties or develop a condition due to some sort of occupational exposure, you may be entitled to benefits including but not limited to medical treatment and help for wage loss. In this case, you do not have to prove that anyone was negligent or at fault to receive workers’ compensation; this is a no-fault system.

Types of Injuries Covered Under Workers’ Compensation

Workers’ compensation laws are designed to cover various workplace-related injuries and illnesses. This can range from physical injuries like broken bones, back and spinal injuries, repetitive motion injuries, or muscle strains that occur from a workplace accident. It also applies to chemical exposure leading to diseases. In California, even mental health disorders are sometimes covered under workers’ compensation laws.

Exclusions from Workers’ Compensation

While workers’ compensation laws in Los Angeles are constructed to be extensive, there are a few notable exclusions as written in California Labor Code Section 3600:

Self-inflicted injuries: Such workplace injuries are not covered under worker’s compensation. There has to be a clear cause-and-effect relationship between the workplace incident and the injury.

Violation of law or company policy: Injuries that occur when an employee is violating the law or company policy often won’t be covered by workers’ compensation.

Injuries suffered while under the influence: Injuries occurring under the influence of drugs or alcohol are also excluded from workers’ compensation.

“Liability for the compensation provided by this division…shall, without regard to negligence, exist…where the following conditions of compensation concur:

Where the injury is not caused by the intoxication, by alcohol or the unlawful use of a controlled substance, of the injured employee.”

Fighting and you were the aggressor: If you were injured because of your involvement in a fight at the workplace and you were the initial aggressor, any injuries you sustain will almost certainly be excluded from a workers’ compensation claim.

Injuries sustained while commuting: Generally, the “coming and going” rule excludes injuries suffered on your way to or from work. Regular commute isn’t considered part of job duties. However, there are exceptions, such as when your employer specifically sends you on an errand.

Understanding what is and isn’t covered under workers’ compensation laws in Los Angeles is vital to ensuring your rights are protected.
